1. General Provisions


1.1. This Policy is implemented by the organization "Uptimex" (hereinafter referred to as the "Organization") regarding the processing and protection of personal data of individuals (data subjects) based on Article 8 of the Law of Ukraine "On Personal Data Protection."


1.2. The Policy applies to all personal data (subjects) that the Organization may obtain in the course of its activities, including clients of the Organization.


1.3. The purpose of the Policy is to provide individuals who provide their personal data with necessary information that allows them to assess what personal data is processed by the Organization, for what purposes, and what methods are used to ensure their security.


1.4. The Policy ensures the protection of the rights and freedoms of data subjects in the processing of their personal data, whether automated or not, and establishes the responsibility of individuals with access to personal data for non-compliance with the requirements regulating the processing and protection of personal data.


1.5. Clients, by using the services of the Organization and providing their personal data, including through third parties, acknowledge their consent to the processing of personal data in accordance with this Policy.


1.6. Consent to the processing of personal data may be revoked by the data subject. In case of revocation, the Organization has the right to continue processing personal data without the consent of the data subject if there are grounds specified by applicable legislation or, otherwise, refuse to provide the service if the personal data is necessary for the provision of such service.


1.7. This Policy may be amended by the Organization.



2. Concepts and Composition of Personal Data


2.1. For the purposes of this Policy, personal data is any information related directly or indirectly to an identified individual (data subject).


2.2. Depending on the data subject, the Organization, for the purpose of its activities and fulfilling its obligations, may process personal data of the following categories of subjects:



  • Personal data of the Organization's employee โ€“ information necessary for the Organization in connection with employment relations regarding a specific employee.

  • Client data โ€“ information necessary for the Organization to fulfill its obligations under contractual relations with the Client and to comply with the legislation of Ukraine.

  • Personal data of the Client provided during registration on the website uptimex.app, including when placing orders.

  • Data automatically transmitted to the Services during their use through user-installed software, including IP addresses, cookie information, information about the user's browser (or other program used to access the Services), access time, and the address of the requested page.



3. Legal Grounds and Purposes of Personal Data Processing


3.1. The Organization processes personal data to carry out its activities, including providing services to Clients. The Organization has the right to:



  • Process the Client's personal data without obtaining written consent from the data subject in accordance with Article 8 of the Law of Ukraine "On Personal Data Protection," as the processing of personal data is necessary for the performance of a contract, where the data subject is a party, a beneficiary, or a guarantor under the contract, or for the conclusion of a contract at the initiative of the data subject or a contract where the data subject will be a beneficiary or a guarantor.

  • Collect and store the Client's personal data necessary for the provision of services, the performance of agreements and contracts, and the fulfillment of obligations to the Client.



3.2. The Organization may use the Client's personal data for the following purposes:





    • providing services to the Client;

    • identifying the Client within the framework of contracts;

    • communicating with the Client when necessary, including sending proposals, messages, information, and requests related and unrelated to the provision of services, as well as processing the Client's applications, inquiries, and requests;

    • improving the quality of services provided by the Organization;

    • targeting advertising materials;

    • conducting statistical and other research based on anonymized data;





4. Processing Periods of Personal Data


4.1. The processing periods of personal data are determined based on the purposes of processing in the information systems of the Organization, in accordance with the term of the agreement or contract with the data subject.



5. Persons Authorized to Process Personal Data


5.1. To achieve the purposes of Article 3 of this Policy, only those employees of the Organization who are assigned such duties in accordance with their official (employment) responsibilities are authorized to process personal data. Access to other employees may be granted only in cases provided for by law. The Organization requires its employees to maintain confidentiality and ensure the security of personal data during their processing.


5.2. The Organization has the right to transfer personal data to third parties in the following cases:



  • The data subject has explicitly consented to such actions, in particular:

    • When providing services to Clients โ€“ accepted the terms of the public offer contract;

    • The transfer is provided for by Ukrainian or other applicable legislation within the framework of the legislated procedure;




All obligations regarding the conditions for ensuring the security of personal data in accordance with the current legislation of Ukraine and international agreements regarding the received data are transferred to the acquirer.



6. Methods of Personal Data Processing


6.1. In the process of providing services and conducting internal economic activities, the Organization uses automated and non-automated processing of personal data.



7. Implementation of Personal Data Protection


7.1. The Organization's activities related to the processing of personal data in information systems are inseparably linked to the protection of the confidentiality of the information received by the Organization. All employees of the Organization are required to ensure the confidentiality of personal data, as well as other confidential information established by the Organization, if it contradicts the current legislation of Ukraine.


7.2. The security of personal data during their processing in the Organization's information systems is ensured through an information security system.


7.3. The exchange of personal data during their processing in the personal data information system is carried out through secure communication channels.


7.4. During the processing of personal data in the personal data information system of the Organization, the following measures are ensured:



  • implementation of measures aimed at preventing unauthorized access to personal data and/or their transfer to persons who do not have the right to access such information;

  • application of network segmentation;

  • physical protection of premises and technical means that allow processing personal data;

  • timely detection of facts of unauthorized access to personal data;

  • prevention of physical impact on technical means of automated workplaces, which may disrupt their functioning;

  • the ability to promptly restore personal data modified and destroyed due to unauthorized access to them;

  • continuous antivirus control;

  • continuous analysis of the security of personal data;

  • use of security attributes;

  • control of the integrity of the software environment for processing personal data;

  • other means and measures in accordance with current legislation.
